Healios, Inc. (“MyHealios” or “we”) online caregiver services designed to educate, train and support caregivers in their caregiving role for an individual with a chronic illness.
1.1 To become a member and access the Member Area, MyHealios requires that you are either a (a) caregiver of a patient with a chronic illness, (b) a patient with a chronic illness, (c) health care professional (e.g. doctor, nurse, health researcher, etc.), (d) guest with legitimate, non-commercial reasons to participate in the community and who agrees to respect the privacy and preserve the dignity of all community participants or (e) guest as authorized by a MyHealios member or employee.
1.2 You must be at least 18 years of age and possess the legal right to enter into an agreement with MyHealios.
2.1 The material provided on the Site, such as text, tips, charts, patient profiles, graphics, photographs, images, advice, messages, forum postings, and any other material provided on the Site are for informational purposes only and are not a substitute for professional medical advice or treatment. MyHealios does not promote the caregiver to provide mental health services. For questions regarding diagnoses and treatment we recommend to contact your or your loved one’s doctor.
2.2 MyHealios does not provide emergency services. If you or the person for whom you care have a medical or psychiatric emergency, call 911 or go to the nearest open clinic or emergency room. If you or the person for whom you care are considering or contemplating suicide, or if you feel that you or the person for whom you care are a danger to yourself or to others, immediately call 911.
3.1 MyHealios education & skills training services are delivered by web conferencing or telephone. Electronic systems used will incorporate network and software security protocols to protect the confidentiality of the user.
3.2 The use of videoconferencing or telephone improves the access to the service but also implies that the caregiver coach will be at a different location from you, potentially in a different state.
3.3 As with any service, there are potential risks associated with the use of telehealth services. These risks include, but may not be limited to:
(i) In rare cases, information transmitted may not be sufficient (e.g. poor resolution or images) to allow for an appropriate discussion between user and caregiver coach;
(ii) In very rare instances, security protocols could fail, causing a breach of privacy of personal information.
You or the caregiver coach can discontinue the session at any time if you and/or the caregiver coach feel that the videoconferencing connection is not adequate for the situation.
3.4 MyHealios education & skills training services contains written notes from sessions available in the private and password protected user area.
3.5 MyHealios education & skills training services include email and telephone communication between you and MyHealios caregiver coaches or other MyHealios staff.
3.6 MyHealios education & skills training services are provided to caregivers for information, educational and training purposes only. We do not provide professional medical or psychological advice, care or treatment.
3.7 MyHealios education & skills training services do not provide medical or psychological diagnosis or treatment and cannot be used in place of a medical, psychological, clinical, therapeutic or any other relationship with a qualified healthcare professional. In particular, it is the patient's responsibility to regularly consult with a qualified health care professional in all matters relating to physical and mental health. Neither the patient, nor the caregivers we serve through our education & skills training services, should consider foregoing, delaying or disregarding professional medical advice because of information obtained from the MyHealios education & skills training services.
3.8 MyHealios does not engage in any conduct that involves the practice of medicine or other health care profession, and you should be aware of the fact that MyHealios is not bound by the professional responsibilities and duties of a medical caregiver coach. Nothing in the MyHealios education & skills training services, nor any receipt or use by you, will be construed or relied on to provide any medical education & skills training services or establish any medical-client or clinical relationship with you or any other person.
3.9 The MyHealios Service is general and educational in nature, and may not apply to the specific facts and circumstances of individual cases. MyHealios does not undertake any obligation to consider whether information, education or training provided to you is either sufficient or appropriate for your particular needs or actual circumstances.
3.10 The MyHealios Service is provided “AS IS”. MyHealios makes no warranty as to the reliability, accuracy, timeliness, usefulness, adequacy or completeness of the MyHealios education & skills training service, and does not accept any responsibility for any action taken or application of know-how, information, tools, strategies or recommendations by any person following information provided through the MyHealios education & skills training service. You are solely responsible for the appropriate use and adaptation of information, education or training provided by MyHealios.
3.11 MyHealios warrants only to you that the MyHealios education & skills training service will be provided using reasonable care and skill.
3.12 MyHealios will use reasonable efforts and diligence to meet any set appointment dates and times, but will not be liable for any failure to do so.
3.13 We may have to cancel an appointment, including due to the unavailability of key personnel, key materials or to events outside of our control. We will promptly contact you if this happens. If we have to cancel an appointment and you have made any payment in advance for services that have not been provided to you, we will refund these amounts to you.
4.1 RESCHEDULING If for any reason you are unable to proceed with an appointment as planned, you can notify us of your decision to reschedule. To reschedule an appointment, please go to the website www.MyHealios.com, and then log in, using your username and password. Once you are logged in to your personal area, use the rescheduling button in your appointment section to reschedule. Or, you can contact our customer service telephone line at 855-313-8152.
4.2 CANCELLING If you change your mind or for any other reason are unable to proceed with an appointment as planned, you can notify us of your decision to cancel. To cancel an appointment, please contact our customer service telephone line 855-313-8152, or log in to your personal area of the website, www.MyHealios.com, and use the cancellation button in your appointment section.
4.3 MyHealios requires that you give us a minimum of 24 hours advance notice for cancelation or rescheduling. If you cancel or reschedule an appointment within 24 hours of the scheduled appointment, or do not attend, for reasons other than an emergency, MyHealios is obliged to charge for the appointment or cancel the credits for unused clinical resources.
5.1 You acknowledge and agree that your right to use the MyHealios service is personal to you. You must be an individual acting in a private capacity. Others, namely corporations or other business entities, unless separately licensed for specific use(s) of the MyHealios education & skills training service, are not authorized to access the Service.
5.2 You agree that all intellectual property rights, such as copyrights, patents, etc., in or arising out of or in connection with the MyHealios service are and shall be owned and retained by MyHealios and/or its commercial partners and affiliates. This includes content, information and materials presented to you through the MyHealios Service as well data and insights we may gather or realize in our efforts to enhance our service offerings. You are only permitted to use this content, information and materials as expressly authorized by MyHealios. You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell or make any commercial use of the MyHealios Service or materials arising out of or in connection with the MyHealios Service, without the prior and express written consent of MyHealios.
6.2 TO THE EXTENT PERMITTED BY LAW, MYHEALIOS EXCLUDES ALL CONDITIONS, WARRANTIES, REPRESENTATIONS OR OTHER TERMS WHICH MAY APPLY TO THE MYHEALIOS SERVICE, WHETHER EXPRESS OR IMPLIED.
6.3 MYHEALIOS MAKES NO REPRESENTATION THAT ALL SERVICES AND/OR MATERIAL DESCRIBED ON THE WEBSITE, OR THE SERVICES AVAILABLE THROUGH THE SITE, ARE APPROPRIATE OR AVAILABLE FOR USE IN LOCATIONS OUTSIDE THE UNITED STATES OR ALL TERRITORIES WITHIN THE UNITED STATES.
6.4 MYHEALIOS WILL NOT BE LIABLE TO YOU FOR ANY LOSS OR DAMAGE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, OR OTHERWISE, EVEN IF FORESEEABLE, ARISING UNDER OR IN CONNECTION WITH USE OF, OR INABILITY TO USE, THE MYHEALIOS SERVICE OR USE OF OR RELIANCE ON INFORMATION, EDUCATION OR TRAINING PROVIDED TO YOU BY MYHEALIOS.
7.1 You understand and agree that that you alone are responsible and accountable for your actions taken, or application of know-how, information, tools, strategies or recommendations by any person following information provided through the MyHealios services. Except as set out in clause 7, you agree not to hold MyHealios liable for any such decisions, actions or results and you will defend, indemnify and hold MyHealios harmless against claims, actions, proceedings, losses, damages, expenses and all costs arising out of or reliance on information, education or training provided to you by MyHealios.
8.1 You are responsible for maintaining the confidentiality of your member password and login, and are fully responsible for all activities that occur under your password or account with or without your knowledge. If you knowingly provide your login and password information to another person, your membership privileges may be suspended temporarily or terminated. You agree to immediately notify MyHealios of any unauthorized use of your membership password or login or any other breach of security.
8.2 Be aware that Internet and e-mail communications are inherently not confidential. It is possible that information transmitted to or from us may be read or obtained by other parties. We welcome your e-mail correspondence but if you need to send confidential information and are concerned about its security, then you should use the messaging opportunity in the membership area space (“contact your caregiver coach”) or consider sending it by phone or by regular mail instead. MyHealios does not communicate sensitive information via e-mail. Via your privacy settings you can choose not to receive other communication, such as confirmation of appointments, via e-mail or text.
8.3 The personal information will only be provided by and collected from you. By choosing to submit your personal information, you are consenting to its collection. You may unsubscribe from communications received by you at any time. You may make a written request for a copy of the personal information held about you. 9.1 We may collect and process the following data about you:
9.1.1 Information that you provide by filling in forms or otherwise submit to us. This includes information provided at the time of registering to use MyHealios education & skills training service, booking an appointment or requesting further services; and
9.1.2 Information that you provide while using the MyHealios Member Area and education & skills training service.
9.2 We will use the personal information you provide to us to:
9.2.1 Provide relevant material on the MyHealios Member Area;
9.2.2 Provide the MyHealios education & skills training service (and subject to clause 1.4, to arrange your appointments as may be appropriate);
9.2.3 We may also ask you to complete surveys that we use for research, analysis and service enhancement purposes, although you may decline to respond to them.
9.3 By submitting your personal data, you agree to the transfer, storing or processing of this data. We will take all steps reasonably necessary to ensure that your data is treated privately and securely as per US laws and regulations relating to the handling of personal data.
9.4 We may disclose your personal information to third parties:
9.4.1 For research and analysis purposes, where we may combine your information anonymously with other peoples' information to pass onto third parties, i.e. your identifiable information will be removed. None of the personally identifying information you provided will be passed on to third parties.
9.4.2 In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets after de-identifying it whereby your personal identifiable information will be removed;
9.4.3 If MyHealios or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets after de-identifying it, whereby your personal identifiable information will be removed;
9.4.4 If we are under a duty to disclose or share your personal data in order to comply with any legal obligation.
9.5 By using the MyHealios caregiver support services, you consent to such use of personal information and you agree that all data provided by you is accurate
10.2 By “calls” we mean any telephone and videoconference communication between you and MyHealios caregiver coach or other MyHealios staff (e.g. Intake Coordinator, Relationship manager, IT support manager).
12.1 We reserve the right to withdraw or amend the MyHealios caregiver support service without notice. We will not be liable if for any reason the MyHealios caregiver support service is unavailable at any time or for any period.
1.1 We may collect and process the following identifying information about you on our website:
1.1.1 information that you provide by filling in forms on our site. This includes information requested at the time of registering to use our site, booking a service or requesting further services;
1.1.2 if you contact MyHealios, we may keep a record of that correspondence;
1.1.3 we may also ask you to complete surveys that we use for research and analysis purposes, although your participation, while appreciated, is not compulsory;
1.1.4 details of your visits to our website including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.
1.2 Many companies offer programs that help you to visit web sites anonymously. While we will not be able to provide you with a personalized experience if we cannot recognize you, we want you to be aware that these programs are available.
2.1 We may collect and store information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information. This is statistical data about users' browsing actions and patterns, and does not identify any individual.
3.2 We may use the following cookies:
3.2.1 Operationally required cookies. These are cookies that are required for the operation of our website. They include, for example, cookies that enable you to log into secure areas of our website or make use of e-billing services.
3.4 You may block cookies by activating the settings on your browser that allows you to refuse the use of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site.
4.1 We use IP addresses to analyze trends, administer the site, track users' movement, and gather broad information for aggregate use. IP addresses are not linked to personally identifiable information.
5.2 Unfortunately, the transmission of information via the Internet cannot be expected to be completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to our site, and any transmission is ultimately at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.
6.1 We use information held about you in the following ways:
6.1.1 to ensure that content from our site is presented in the most effective manner for you and for your computer;
6.1.2 to provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes;
6.1.3 to carry out our obligations arising from any contracts entered into between you and us;
6.1.4 to notify you about changes to our service.
6.2 We do not disclose information about identifiable individuals, but we may provide third parties with aggregate information about our users (both website users and users of the MyHealios Telephone Service) to analyze for various purposes, including improving service content and delivery, or outcomes analysis. Where we provide aggregated information, information about identifiable individuals will not be identifiable within the aggregated data.
8.1 If your personal information changes (such as address or phone number), or if you no longer desire our service, you can edit you data in the member area. Users can also reach us at firstname.lastname@example.org or 855-313-8152.
8.2 As a user you are provided the opportunity to "opt-out" of having your personal information used by third parties for purposes not directly related to our site at the point where we ask for the information.
8.3 Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by updating the user preferences in the member area.
9.1 We may disclose your personal information to third parties:
9.1.1 in the event that we sell or buy any business or assets, in which case we may disclose your non-identifiable personal data to the prospective seller or buyer of such business or assets;
9.1.2 if MyHealios or substantially all of its assets are acquired by a third party, in which case non-identifiable personal data held by it about its customers will be one of the transferred assets.
9.2 We may share aggregate information with our partners. This aggregate information does not contain personally identifiable information and therefore cannot identify any specific individual. When the user signs up for use of specific services, we will share names or other contact information that is necessary for the third party to provide these services only after permission of the user. The parties providing such services are not allowed to use personally identifiable information except for the purpose of providing these services.
9.3 If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of website use or our terms of telephone service use; or to protect the rights, property, or safety of MyHealios. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
10.1 Our site may contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies, and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.
11.1 MyHealios has implemented procedures to reasonably protect data security and the use and disclosure of Identifiable Information. "Identifiable Information" means information about a participant in one of MyHealios' research programs or service offerings, which information reveals the identity of the participant or reasonably could be used to identify the participant. MyHealios protects the identity of participants in these programs; MyHealios does not disclose Identifiable Information unless the participant has permitted such disclosure or it is allowed or required by law. MyHealios has implemented procedures designed to protect the privacy and security of Identifiable Information, which procedures are described here. MyHealios uses and discloses Identifiable Information only as appropriate under and described in this Policy Statement. MyHealios stores or maintains Identifiable Information obtained in the course of administering its services and in its research programs in secure locations and limits access to Identifiable Information to workforce members and third parties that need to have such access in order to achieve only these specific purposes. MyHealios' workforce members use and disclose Identifiable Information only as described in this Policy or as permitted or required by law. When MyHealios receives Identifiable Information from sources other than the participant or user, MyHealios enters into confidentiality agreements with the entity(ies) that provide such information to MyHealios. Those confidentiality agreements require protections at least as stringent as those described in this Policy. MyHealios enters into confidentiality agreements with subcontractors and other third parties to which MyHealios provides Identifiable Information. Those confidentiality agreements require the third parties to implement protections for the privacy and security of such information at least as stringent as those described in this Policy. Prior to providing research results to clients, MyHealios removes Identifiable Information. At the conclusion of each research program, MyHealios uses reasonable efforts to destroy or de-identify (make anonymous) all Identifiable Information, unless the participant has agreed to be re-contacted about future research programs or MyHealios is otherwise required by contract or permitted or required by law to maintain such information. MyHealios does not and would not knowingly use or disclose Identifiable Information in violation of any privacy or security law or agreement. If we are ordered to use or disclose Identifiable Information in a legal proceeding, MyHealios will take reasonable steps within the context of that legal proceeding to inform the court or other decision-maker of the confidentiality of the information, and MyHealios will take reasonable steps to otherwise maintain the confidentiality of such information. MyHealios uses reasonable and appropriate safeguards to protect the security of Identifiable Information, including specifically the confidentiality and integrity of such information.
